Exceptional Work Permit
By complying with the labor force policy regulated by the Ministry of Labor and Social Security, foreigners with the qualifications specified in the International Labor Law No. 6735 can be exceptionally granted a work permit. The foreigners, which are regulated in Article 16 of the said law, titled “Foreigners to whom a work permit can be granted exceptionally”, are considered limited by the legislator, and the following persons can apply for an exceptional work permit.
- Foreigners who are considered as qualified workforce in terms of education level, experience, contribution to science and technology;
- Foreigners who are considered as qualified investors in terms of their investment and export quality in Turkey, the employment power they will provide and their contribution to science and technology;
- Foreigners who will work for a certain period of time in a project in Turkey;
- Foreigners who are declared to be of Turkish Nobility by the relevant Ministries;
- TRNC (Turkish Republic of Northern Cyprus) citizens;
- Citizens of EU (European Union) member countries;
- Foreigners who are married to a C. citizen and live in a marriage union;
- Foreigners who have applied for international protection in the Law on Foreigners and International Protection No. 6458, are conditional refugees, stateless, have temporary protection, are victims of human trafficking;
- Foreigners working in Turkish representations of foreign states or international organizations without diplomatic immunity;
- Foreigners who are cross-border service providers;
- Foreigners who have international success in their field and who will come to Turkey for sporting, artistic, scientific or cultural purposes.

What is an Exceptional Work Permit?
Exceptional work permit is a type of work permit and is issued by the Ministry of Labor and Social Security like other work permits. Exceptional work permit does not grant the applicant a work permit exemption. As with other types of work permits, the foreigner must obtain a work permit before starting to work.
In exceptional work permit applications, the Ministry does not apply the criteria for the evaluation of the work permit.
How to Obtain an Exceptional Work Permit?
Work permit applications of foreigners who meet one of the conditions listed above are made exceptionally. Exceptional work permit applications do not show any difference in terms of application and provide convenience in the evaluation stage made by the Ministry.
As we have mentioned in our other articles titled work permit , work permit applications can be made in two different ways, domestically and abroad. If the foreign national for whom a work permit application has been duly made is one of the following persons, the permit evaluation criteria are not applied at the evaluation stage.
- Evaluated foreigners with qualified workforce;
- Evaluated foreigners who are qualified investors;
- Project worker foreigners;
- TRNC citizens;
- EU citizens;
- Foreigners applying for international protection;
- Conditional refugees;
- stateless people;
- Those who are victims of human trafficking;
- Foreigners working in the representation of international organizations in Turkey;
- Internationally successful foreigners;
- Cross-border service provider foreigners.
The following criteria determined by the Ministry of Labor and Social Security are not applied to foreigners who meet one or more of the above conditions and apply for an exceptional work permit.
- The workplace applying for a work permit must employ at least 5 Turkish citizens;
- The workplace applying for a work permit must have a paid-in capital of at least 100,000 TL. Establishments with a paid-in capital of less than TL 100,000 must have a gross sales of at least TL 800,000;
- The paid-in capital of the foreign company partners who apply for a work permit must be at least 40,000 TL and at least 20% of the capital share must belong to the foreigner;
- 6.5 times the minimum wage if the foreign national is a senior manager, pilot and architect and engineer with a preliminary permit request, 4 times the minimum wage if the foreigner is an architect and engineer without a preliminary permit request, a branch or unit manager, teacher, psychologist, physiotherapist A monthly salary of at least 3 times the minimum wage in case of employment and specialization, at least the minimum wage in case of domestic services, and 1.5 times the minimum wage for foreigners who will work in any profession other than these professions;
Documents Required for Exceptional Work Permit
The documents required in the exceptional work permit application are not different from the documents requested in the ordinary application route. If the foreigner applies for a work permit from abroad, the reference number obtained from the Foreign Representation of the Republic of Turkey is requested. The employer or his representative can apply for a work permit with this reference number. For applications to be made from within the country, the foreigner must have a residence permit for at least 6 months.
The documents used during the application consist of the following;
Documents required from foreign nationals:
- For work permit applications to be made from abroad, the 16-digit reference number obtained from the Foreign Representation of the Republic of Turkey;
- Photocopy of the foreigner’s residence permit for domestic applications;
- Copy of the foreigner’s passport or valid identity document;
- Notarized copy of the diploma with Turkish translation (not required for home services);
Documents required from the employer:
- Application Petition (prepared by us);
- Application Form (prepared by us);
- Turkish Trade Registry Gazette showing the latest capital and partnership structure of the organization (for Company Applications);
- Balance sheet and profit/loss statement for the last year approved by the tax office or certified public accountant (for Company Applications);
- Power of Attorney (required for applications made by us).
