As we stated in our previous articles on the subject of work permit for foreign engineers and architects, the work permits and procedures of foreigners are regulated by the International Labor Law No. 6735. There are administrative and penal sanctions for foreign nationals to operate in Turkey without a work permit.
What are the Terms of Employment of Foreign Engineers and Architects?
Pursuant to the text of the law regulated in Article 20 of the said law titled Foreign Engineers and Architects , foreign engineers and architects can work in Turkey by obtaining a work permit if they meet the following conditions .
- To graduate from any higher education institution providing Engineering and Architecture education in Turkey;
- Receiving equivalency certificate from the Council of Higher Education (YÖK) for engineering and architecture diplomas obtained from abroad;
- To work with foreign architects and engineers on a project basis and on a temporary basis.
On the other hand, in accordance with the Regulation on the Evaluation of Foreign Engineers, Architects and City Planners as a basis for Work Permits and Applications for Temporary Membership of the Union of Chambers of Turkish Engineers and Architects, foreign architects and engineers have to be members of professional chambers in accordance with the procedures to be followed in the works and transactions to be carried out regarding foreign architects and engineers.
Pursuant to Article 5 of the regulation, foreign engineers and architects are required to obtain permission from the Ministry of Labor and Social Security.
Employers who want to employ foreign engineers or architects are required to pay the foreigner a monthly salary of 4 times the minimum wage. Otherwise, work permit applications will not be accepted by the Ministry.
How to Get a Work Permit for Foreign Engineers and Architects?
- Work permit application is made to the Ministry of Labor and Social Security at home, and to the Foreign Representative of the Republic of Turkey of the country where the foreigner is a citizen or permanent resident from abroad;
- Applications are made electronically by the employer or the person to whom he/she gives power of attorney;
- If the application is made domestically, the foreign national must have a residence permit for at least 6 months and the residence period must not have expired;
- If the application is made from abroad, the foreigner must inform the employer of the 16-digit reference number given to him by the foreign representative office. The employer or his representative has to enter the reference number into the electronic system;
- The employer requesting a work permit must employ at least 5 Turkish citizens;
- The capital of the employer company must be at least 100,000 TL. Companies with a capital of less than TL 100,000 are required to have a gross sales of TL 800,000;
- Foreign architects and engineers whose work permit applications are accepted must be insured by SGK for 30 days at the latest. Work permits of foreigners who do not enter SSI insured within 30 days are cancelled.
- Insurance entries of foreign architects and engineers must be made at least over the wage shown in the employment contract.
- In line with the criteria determined by the Ministry of Labor and Social Security, foreign architects and engineers are paid monthly, at least 4 times the minimum wage.
