What is a Residence Permit?
It is a permit document that foreigners who will stay in Turkey longer than the visa exemption period applied to their country of citizenship must obtain from the Provincial Immigration Administration.
Where are Residence Permit Applications Made?
Residence permit applications are made to the Provincial Immigration Administration, which is under the governorships.
Do I Need to Come for a Residence Permit Application?
The foreigner can apply for a residence permit himself or through his legal representative or lawyer. The administration receiving the application may also request the presence of the foreigner himself.
How Much is Residence Permit Document Fee and Fee?
The residence permit card fee has been set as 72.00 TL for 2018. The residence permit fee varies from the nationality of the foreigner to the country of residence.
Is there a repeat application for missing documents?
In case of missing documents, there is no need to apply again. Missing documents are reported to the foreigner on the day of the appointment and a 15-day period is given to the foreigner to complete these documents. If the missing documents are completed within this period, the transaction is canceled.
What are the Short-Term Residence Permit Conditions?
- To apply for a short-term residence permit to the Immigration Administration and to submit the necessary documents;
- not be banned from entering Turkey;
- Possess a legally valid document that replaces a passport or passport substitute travel document;
- A passport with a validity of at least 60 days from the time indicated as the expiry date of the residence permit or a valid document in its place;
- To have housing conditions suitable for the determined health and safety factors;
- If requested, the criminal record obtained from the authorized institutions of the country or the third country where he/she is legally residing;
- Notification of the foreigner’s address to stay in Turkey;
What is the Duration of Uninterrupted Residence Permit and How is it Calculated?
In order for the foreigner not to suffer from a residence interruption, he/she must stay outside of Turkey for a maximum of 6 months in 1 year, and a maximum of 1 year in 5 years. When calculating uninterrupted residence permit periods, half of the periods of residence as a student are taken into account.
Who Can Be Exempted from a Residence Permit?
In accordance with the principles of both national and international law, the foreigners specified below are exempted from residence permit.
- Those who are within the visa and visa exemption period;
- Those who came out of Turkish citizenship by obtaining permission;
- Those who are registered in the International Protection Application;
- Those who are granted residence permit exemption pursuant to international agreements to which Turkey is a party;
- Diplomatic residents of Turkey, foreigners working as official officials in the foreign representative offices of their country in Turkey and their families;
- Employees of the Turkish branches of international organizations;
- Those who have applied for International Protection;
- Those with International Protection Status;
- stateless people;
- Those who have a work permit issued by the MoLSS.
What is an Entry Ban?
It is the situation where the foreigner is prohibited from coming to Turkey by the Governor’s Office or the General Directorate of Migration Management.
How Many Years Is the Entry Ban Period?
A foreigner is banned from entering the country for a maximum of 5 years. However, if the foreigner poses a threat to public security, this period can be increased by the General Directorate of Migration Management for a maximum of 10 years.
What is the Deportation Order and Who Is It Applicable To?
The deportation decision is the decision taken by the governorates to send the foreign national from Turkey to a country of origin or to any third country. In case of one of the following situations, the governorship may take a deportation decision for the foreigner concerned.
- Those who are considered to be deported to foreign nationals who are sentenced to imprisonment for committing any of the crimes in the Turkish Penal Code;
- Those who are members, managers or supporters of a criminal or terrorist organization;
- Those who submit false documents using false information while entering Turkey and obtaining a residence permit;
- Those who earn illegitimately;
- Those who act against public security and public order and those who carry epidemic diseases that threaten public health;
- Those whose visa has been cancelled, who stay in Turkey for more than 10 days after the visa exemption period expires;
- Those whose residence permit has been revoked;
- Those who have been in Turkey for more than 10 days without justification after the expiry of the residence permit;
- Employees without a Work Permit;
- Those entering and leaving Turkey unofficially;
- Those who were found to have come to Turkey despite a deportation decision;
- Those whose applications for international protection are rejected;
- In cases where foreigners whose residence permit extension applications are rejected do not exit within 10 days.
