Turkey V84 Conditional Entry
As we mentioned in our previous articles, foreigners can reside in Turkey during the visa or visa exemption period. Foreigners who want to reside in Turkey for a longer period of time are required to obtain a residence permit.
In the past, foreigners who continued to reside in Turkey without a residence permit were deported from the country and an entry ban was imposed on them for 5 years. With the entry into force of the Law on Foreigners and International Protection No. 6458 on April 11, 2014, a number of new regulations have been introduced regarding the legal status of foreigners. According to the new regulation, foreigners who have passed the visa or visa exemption period can now leave Turkey without being deported by paying their fines at the border gates. There is no obstacle for these people to re-enter Turkey. Foreigners who pay the fine at the border gate can enter Turkey conditionally under V84 .
What is Deport and V84?
The entry ban on foreign nationals issued by the General Directorate of Migration Management or the governor’s office is also known as deport among the people. A foreigner with an entry ban is deported from Turkey either to his own country or to be sent to another country. Two types of entry bans can be given to the foreigner as temporary and indefinite. Foreigners who have an entry ban are prohibited from entering Turkey. Pursuant to the new regulation, an entry ban for a maximum of 5 years can be imposed on foreign nationals, and then it can be extended for another 5 years. An indefinite entry ban is the prohibition of a person from entering the country for a certain period of time.
In cases where the foreigner resides in Turkey without a residence permit and works without a work permit by violating the visa or visa exemption period, a temporary entry ban is issued. If the foreigner who violates the visa or visa exemption period under V84 leaves the country voluntarily and pays the fine, there is no entry ban on this foreigner. Foreign nationals who pay the fine can enter Turkey conditionally. The foreigner who enters conditionally must apply for a residence permit within 10 days at the latest.
What Happens If Conditional Entry Time Is Exceeded?
Conditional right of entry is given to a foreigner who has previously resided in Turkey in violation of the visa or visa exemption period and left the country by paying the fine. Foreigners who enter conditionally must apply for a residence permit to the Immigration Management Directorate of the province or district where they reside within 10 days.
The 10-day period is regulated as a period of disqualification, and those who do not apply within this period will be subject to a temporary entry ban to Turkey. In other words, these people will be deported from Turkey.
