WHAT ARE THE TYPES OF WORK PERMIT?
There are 9 different types of work permits in different standards . These;

Temporary Work Permit:
For the foreigner whose application for a temporary work permit is accepted, provided that it does not exceed the duration of the employment or service contract, the employment granted for a maximum of 1 year in the applications made for the first time, on the condition of working in a specified job in a certain workplace of real persons, legal entities or public institutions and organizations. is permission.
If the application made by the foreigner to extend the duration of the work permit types is positive, the foreigner is allowed a maximum of 2 years in the first extension application, provided that the foreigner is affiliated with the same employer. For subsequent extension applications, a maximum of 3 years is allowed.

Indefinite Work Permit:
A long-term residence permit in Turkey or an indefinite work permit is a type of permit given to foreigners with a legal indefinite duration of at least 8 years. The fact that the foreigner meets the application conditions does not necessarily entitle him to obtain an indefinite work permit.
The foreigner who has an indefinite work permit can benefit from all the rights provided by the long-term residence permit. Except for the regulations in special laws, foreigners holding an indefinite work permit can benefit from all the rights granted to Turkish citizens if they have acquired rights regarding social security, provided that these rights are reserved and the relevant legislation provisions are applied in their use. Foreigners holding an indefinite work permit do not have the right to elect, be elected, enter public office, or have military service obligations.
Independent Work Permit:
It is an independent work permit that allows the applicant to work in Turkey on his own behalf and on his own account.
Independent work permit can be given to foreigners with professional occupation, provided that the special conditions specified in other laws are met.
While examining the application of the foreigner applying for this permit, his/her education level, contribution to science and technology, work experiences, the impact of his activity or investment in Turkey on the Turkish economy and labor force, capital share if he is a foreign company partner, and other issues to be determined by the Ministry in line with the recommendations of the International Labor Policy Advisory Board. are taken into account. The permit is issued for a certain period of time.

Exceptional Work Permit:
Foreigners who can obtain an exceptional work permit, which is among the types of work permits, are as follows:
- Education level, professional experience, contribution to science and technology, etc. foreigners who are considered as qualified labor force due to their qualifications,
- Its contribution to science and technology, the level of investment or export, the size of the workforce it will provide, etc. Foreigners who are considered as qualified investors due to their characteristics,
- Foreigners employed by their employer in a project to be implemented in Turkey within a certain period of time,
- Foreigners who are declared to be of Turkish descent by the Ministry of Interior or the Ministry of Foreign Affairs,
- Citizens of the Turkish Republic of Northern Cyprus,
- Citizens of European Union member countries,
- International protection applicant, conditional refugee, temporary protection, stateless or human trafficking victims who benefit from the victim support process,
- Foreigners who are married to a Turkish citizen and live in a marriage union with their spouse in Turkey,
- Employees without diplomatic immunity at the representations of foreign states and international organizations in Turkey,
- Foreigners who have international success in cultural, artistic or sports fields and come to Turkey for the same purposes,
- Foreigners who are in Turkey temporarily and for the purpose of providing any service and receive their wages from a source in Turkey or outside of Turkey.
Foreigners who have applied for international protection and whose application has not been finalized yet or who are conditional refugees; 6 months after the international protection application date and the foreigners under temporary protection, 6 months after the temporary protection identity document is issued, they can apply for a work permit or exemption.

Foreigners to work in free zones:
The permit applications of foreigners who will work in free zones within the scope of the Free Zones Law are evaluated by the Ministry of Economy. The Ministry of Economy notifies the Ministry of Labor and Social Security of the applications of foreigners that it deems suitable for obtaining a permit as a result of its evaluation. A work permit is issued by the Ministry of Labor and Social Security for foreigners notified by the Ministry of Economy.

Foreign students:
Foreign students enrolled in a university degree formal education program in Turkey can work in Turkey by obtaining a work permit. Students who are studying at associate and undergraduate level can apply for leave and work part-time after completing the first year of their education. These restrictions do not apply to students studying at a graduate degree.

Foreign engineers and architects:
Foreigners who have graduated from engineering and architecture faculties in a higher education institution in Turkey or in a higher education institution abroad recognized by the Higher Education Council can work with a work permit . Foreign lecturers:
REQUIRED DOCUMENTS FOR WORK PERMIT APPLICATION
Applications for work permit types can be made to the foreign representatives of the Republic of Turkey in the form of both visa and work permit applications. In addition, if the foreigner is in Turkey and still has a valid residence permit for at least 6 months, an application can be made from within the country for this permit. After the necessary forms and documents are prepared, they should be submitted to the ministry within the stipulated time.
Documents required in the first application;
A- Documents Required from Foreigners
- Foreign Personnel Application Form
- Residence permit for at least 6 months, excluding residence permits for associate degree and undergraduate education valid on the date of application
- Copy of passport (Applications made with a passport or a document that replaces a passport with a validity of less than 60 days as of the date of application for work permit are not processed)
- For foreigners who will work within the scope of professional services and foreigners who will work in other professions deemed necessary by the Ministry, a certified translation into Turkish or a copy of a diploma or temporary graduation certificate approved by official authorities, and a sample of pilot license for foreigners who will work as pilots should be attached.
- For Certified Tourism Enterprises that will employ foreign artists, the employment contract and its approved translation in Turkish and in the language of the foreigner or a testimonial approved by the official authorities
- In addition to the above documents, the foreigner applying to perform professional services must submit a “Diploma or Temporary Graduation Equivalency Certificate” if he/she has higher education abroad.
- For foreigners who will work in private education institutions affiliated to the Ministry of National Education, a document showing the qualification of the foreigner obtained from the Ministry of National Education (preliminary permission)
- For foreign health officials who will work in some private health institutions affiliated to the Ministry of Health, the document regarding the professional competence obtained from the Provincial Health Directorate (preliminary permission)
- For foreign pilots to be employed in workplaces operating in the aviation sector, a Turkish translation of a sworn translator or a Pilot License approved by official authorities will also be added.
B- Documents Required from the Institution / Organization to Employ Foreign Personnel
- Permit application letter
- Balance sheet and profit / loss statement for the last year approved by the tax office or certified public accountant,
- Turkish Trade Registry Gazette (must show the latest capital and partnership structure of the organization)
- For private education institutions that will employ foreigners, “Permit to Open an Institution and Start Education” and “License” obtained from the Ministry of National Education,
- “Operation Permit” obtained from the Provincial Health Directorate for private health institutions that will employ foreigners,
- For associations, foundations and health care organizations, a document showing the activity status of the relevant authorities
- In legal entities that will employ foreign experts as engineers / architects / city planners, payroll proving that Turkish is employed in the same profession
- Operation and Investment Certificate from the Ministry of Culture and Tourism for foreigners to be employed in workplaces with a tourism operation certificate, if not a certified enterprise, an Activity Certificate from the Chamber of Commerce
Obligatory Matters to be Included in the Employment Contract with Foreign Artists:
Foreign artists, who are among the types of work permits, must submit a record that their employer will cover the return tickets and travel expenses to be taken to return to their country after their working period ends. In addition, it must be documented that their wages will not be less than 3 times the minimum wage, which changes every 6 months. The tax number of the workplace and the rights of the employee should also be included. - A document showing that organizations and consortia, which have the right to realize internationally tendered projects in public institutions and organizations, have undertaken the work to be received from the relevant institutions and organizations.
- The payrolls of legal entities that will employ foreign experts for architecture, engineering, contracting and consultancy services must be documented, proving that they employ Turkish workers in the same profession and field.

OTHER DOCUMENTS REQUIRED ACCORDING TO THE TYPES OF WORK PERMISSION
Temporary Work Permit
- If the spouse and dependent children of the foreigner who has come to Turkey to work will request permission, a document to be obtained from the provincial immigration administration proving that he has been legally and uninterruptedly residing with the foreigner, who is the main permit holder, for at least 5 years.
Indefinite Work Permit
- For foreigners who have legally and uninterruptedly resided in Turkey for at least 8 years, a document obtained from the provincial immigration administration or

Independent Work Permit
- Documents proving that the foreigner has scientific, technical or professional competence in the field of work to be performed
